Kudos To Atzenhoffer

Councilman Mark Atzenhoffer has placed a resolution on tonight's agenda requesting the DA file for a declaratory judgment on DA BAGS issue. Way to go Mark. Hope you get the votes. That is a way to get it into court. But, I don't know whether how much money is due is a proper question for that type procedure, but let us find out. I've been for it going to court all along. Let's force U.S. Flood to prove how much they are owed.

The Resolution is deficient -- given some of Cam's mis-steps and erroneous legal advice --- THEREFORE the Council - by including it in the Resolution - should direct Cam to do certain things:
a) Join as a Party to the lawsuit the La. State office which is holding the Money (GOHSEP?)
b) Seek a Court Order immediately to Bind all of the Money pending further Order of Court (so that it cannot be "de-dedicated" and taken back - leaving the Parish ("Taxpayers") on the hook
c) Bifurcate the issues between the Oral Contract during the Period of the Emergency -- and later
d) Define the Terms of what the Contract can be and will be (the Contract has not yet beeen presented to the Council for approval):
--1) that the Rental is for Deployed Bags only - as was then publicly declared by US Flood Control (USFC)
--2) determine the Number of Bags deployed
e) determine what the minimum and maximum prices or rates that can be charged
f) assert and declare that USFC is Not entitled to Attorneys Fees on top of what is due -- for USFC has yet to properly set forth what the proper Amount Due is (as required by this penalty statute).

Man , this guy really has his act together. To bad the council won't do it cause it is the right thing to do. Charlotte would have a baby or heart attack if it did.

The Council,last night, did exactly what Mr. Morvant wanted them to do.
